Why have your own Buyer Broker?

An increasing number of homebuyers are asking a professional licensed Realtor to represent them as a Buyer Broker in property transactions.

Here's why: Under New York State Real Estate Law there are very specific requirements and limitations on who an agent works for and what his or her legal responsibilities are.

LOYALTY: As a licensed real estate agent, I must always act in the best interest of my client -- either the seller or the buyer. Only with the informed written consent of both buyer and seller is dual agency permissible in New York State.

YOU ARE THE BOSS: As your buyer broker, I must follow your lawful instructions in the negotiations.

FULL DISCLOSURE: As your Buyer Broker, I will keep you fully apprised of:

CONFIDENTIALITY: As your buyer broker, I must maintain confidentiality of any discussions with you, or information about you that should not be revealed to others. Of course, this does not preclude my responsibility for fairness and honesty in dealings with all parties.

ACCOUNTABILITY IN THE TRANSACTION: As your agent, I will report where any of your money placed in the hands of the seller's broker is kept for safekeeping.

REASONABLE SKILL AND CARE: As a Buyer Broker, I will help you in arriving at a reasonable purchase price. I will affirmatively investigate material facts of the transaction and disclose them to you, the buyer.


Accredited Buyer Representative (ABR)

The Accredited Buyer Representative (ABR) designation, conferred by the Real Estate Buyer's Agent Council (REBAC), confirms an agent's mastery of the relatively new practice of buyer representation. In the past, virtually all real estate agents owed fiduciary duties to the seller. Even when working with buyers on a day-to-day basis, agents were obligated by law to get the highest price and best terms for the seller.

Today, many consumers prefer working with an agent who is contractually bound to represent their interests as the buyer. Agents who have earned the ABR designation have demonstrated experience in buyer representation. Two key areas emphasized in ABR training are: how to identify potential problems with a property and how to negotiate the best price on behalf of the buyer.
